Be careful who you deal with. Even some bus nuts can be crooks. I bought a bay car from a person on this board last year. Since then, my wife got ill, had to quit her job, money got tight. We are now on the comeback and I inquired about the car. I was told the car was given away and I will not get my $1000 back. I am sitting here with the title, receipts, and all e-mail correspondence with the person. I guess a lawsuit is next. Any suggestions? We live approximately 1200 miles apart.
I guess "lawsuit" is the wrong terminology. What it will be is "criminal charges" for fraud.
Except for your personal satisfaction it is likely to end up costing you more than you will ever recover.
If you are a nasty person and can prove what you say post the person's name and try to shame him. Other than that lick your wounds and walk away. It was a $1000 education.
I'll bet all of us have been taken advantage of at one time or another and unless we want to lower ourselves to the same level as those who mess with us we are just better to chalk it up to experience and move on.
Best you can do is post facts, wouldn't want to give them the chance to get you for slander. . . .
Letting others know so as to help them avoid the same mistake is often the best you can do after something like this happens.
There are always 2 sides to the story - sometimes the other side sounds differently to others than you expect.
As for me, I've spent lots more to learn less, so you have company in that area. . . . .
BTW,
wayne medlin in Tx is a slick talker - my advice in dealing with him is to make sure the payment clears before you send him anything.
Good luck
Since you have the title and all the paperwork, why not call the police and report it stolen and name the man who cheated you as the suspected thief.
Worth a try. When I was building my Quonset hut in Colorado the first crook I hired to put in a garage door ripped me off to the tune of $1200 dollars and after talking to a lawyer he told me you can sue and win but it will cost you more than the loss and then no guarantee of getting the money.
What happened to a man's word is his bond. I know mine still is.

Correct me if I'm wrong but if any vehicle is left unattended long enough it becomes property of the property owner? ? ? I'm by no means taking any sides! I'm just trying to understand this better

If the $1,000 was a deposit, you're not entitled to get a deposit back if you don't go through with the purchase. If it was full payment and title was transfered, you have a leg to stand on. What is a bay car, anyway? There is more to this story, I just know it!
Brian
$1000. sounds like a small claims court jurisdiction if you wanted to pursue that. Sounds like it would be a real nuisance though. Who are we talking about here?
The car was paid in full $1000. I will not name the person until he has a chance to respond. The car was a 1969 Honda that was shortened to fit in the bay of the bus. I'm not mad about not getting the car, I just want my money back.
If you have the title in your name does it not become stolen property?
I would call the District Attorney in the city where you purchased the car. A lot will probably depend on what was agreed upon and documented in the emails. I wouldn't post any more details until you speak with an attorney.
So, you bought something a long time ago and didn't pick it up.
--Geoff
I wasn't going to wade into this one, but I've reached the age where I often think, "Oh, what the hell. Let's see what happens."
You made a deal. You paid for the goods. You probably indicated you would pick up said goods by a certain time. Life happened while you were busy making plans
and you were not able to keep your promise. Meanwhile this fellow had a car sitting in his way, one which I gather he didn't want in his way any longer because he
sold it to you with the understanding you were going to come get it and get said car out of his way. A year went by (or at least a significant portion of a year).
I don't need to see or hear the rest of the story. Basically, you owed the previous owner of the car storage fees, and he collected on it. It is his right to dispose of the
property which you abandoned, and which you forfeited due to non-payment of said storage fees, any way he chooses. He doesn't owe you a cent.
Suck it up, cupcake. Sometimes you gotta just tuck the tail between your legs and walk away.
And, honestly, I don't think public disparaging a fellow busnut over your screwup would be a wise call.
Only if in the emails, were the terns and 'storage fees' agreed upon. You can't unilaterally assign a fee and have it binding. I don't disagree with your premise, but the devil will be in the email details.
for all we know, he tried to collect the car multiple times and the owner was never there.... the plot thickens :)
Not to have fun at your expense, but to illustrate a point.
Really ? if you bought it from me... it would still be sitting there waiting on you.
I agree it ain't worth an attorney.
The way I see it a man's word is his word. PERIOD.
But some get a kick out of kicking a man when he's down.
How much room can a sawed up Honda take.
Was there an agreement to dispose of the car...a time limit...
A fellow busnut...wouldn't do a thing like that.
A jerk would.
Let's see how many ignores I get for this post.
I happen to agree with you 100%, but, laws were not written by 'gentlemen of their word' they are written by lawyers and politicians, and there is the problem.
1000 bucks? When diesel was high a few years back it cost me that much to fill our tanks, can you afford to just walk away from it? If so do so.
Just how big a fellor is this car thief :o
Many times the reason for selling something is to make room. I've sold some big stuff like a small car size before and I would be upset if it never got picked up after a couple of months. Especially if my wife wanted it gone. Oh god I would never hear the end of it if that was the case. But clear communication between the two sides is important. At some point it's unreasonable to still leave it there unless it was agreed upon. Two sides to every story as previously stated though. It's a bad situation from the view of both sides I'm sure.
I had reason to look into this once, there was property stored in my building when I bought it and I didn't know who owned it. In law, generally, the idea is that ownership of abandoned property goes to the possessor of the property, who has a right to either own it or dispose of it. "Abandoned" will vary in different jurisdictions, as will requirements for notice if the owner is known. Even if the owner is known, if the property is abandoned under the definition of the jurisdiction ownership will revert to the possessor. A car left on someone's property would probably fall into "abandonment" after some period of time.
FWIW
Brian
I don't like to even comment on these things because we only get one side of the story. I have 2 questions.
1. You said, in part, "I bought a bay car from a person on this board last year. "
Q. Why did you not pick it up?
2. How long should you expect that they would hold it for you?
Danny
He already said...his wife was sick, money and distance were a hurdle.
The owner/seller gave it away.
Only a jerk would keep the money.
or a thief.
? was the title ever transferred, there are not that many of the bays cars around I have a friend that has one if he has yours which I doubt knowing him he would give you the car if it is the same car
Was it like this one ?

Here in South Dakota it's 30 days to be considered abandoned. You can then start the title application process. Did you ever transfer title? If not your looking at a civil suit to get you money back from this individual.
Bruce
While his situation is unfortunate, why bring it up on here? Sounds like it could have been dealt with one on one or perhaps a lawyer if push comes to shove. Probably a lack of communication on behalf of both concerned.

Legal and right are not the same thing.
It's nice to be nice, but not everyone agrees.
Makes no sense to me his post he is warning people not to do business with this person but yet he doesn't give up the name
I'm not warning people not to do business with him. In the beginning, he was too busy to measure and weigh it for shipping. It was his busy season. No problem. When I couldn't find a reasonable price, he found me a good price for shipping ($425) My wife fell ill. Two months later, I phoned the shipper. Price went up to $775 (original quote was a mistake, apparently.) Frankly, nothing else mattered besides my wife's health for the next few months. I called this month to arrange shipping, was told it was given away. I'm not looking to crucify someone, I'm just looking for suggestions. I live in Canada and he is in the USA.

My suggestion is to forget about it.

Unfortunate that your wife fell ill. The reality is it only takes less than a minute to pick up a phone , call, leave a message , text, email , write a letter to COMMUNICATE with someone your dealing with, especially over a few months? really?
Obviously the car was the least of your problems at the time and you lost it, sorry Dude, get over it.
All u people hollering get over it give him his grand back and I'm sure he will get over it sooner ;D
Did the seller know your wife had health issues? If so that's sort of rotten
1K is quite a bit of money, if one doesn't make much. I really feel for the OP in this thread.
In the mean time, this thread is kinda interesting. ;D Carry on ;)

$1000 is a lot of money. I'm on a disability pension, my wife is the "bread winner" in the family. This car was a big purchase for us, a "toy". I can't afford to just forget that kind of money. I will try to post a picture of it.( I'll get my granddaughter to show me how) lol
Plain and simple...you don't keep something that is not yours.
How do you justify keeping $1000.00 you did not earn ?
WTF ??? The car is gone, he gave it away... bet he didn't give away the money.
Communication goes two ways... come get your car OR I am sending back your cash and giving it away... ::)
Hey Clifford, all of this smacks of the "Internet Bully" a couple of years back. Remember that one?
Page after page of mind numbing opinions on a bully who never quite materialized. Same thing here, "I got ripped off by someone, but I cannot say by who ... Why not?"
At least here, they cannot throw you off, refuse you access, or run you outta town, for reporting some dirty-egg sucking dog that stole your money.
Everything in life has trade offs.
Recently I got beat out of about $60 by some clown, but the price was okay with me, because I no longer have to deal with him or his _______ buddy. I got rid of two irritants in my life, now they are gone.
Take your licking and stop every now and then to smell the roses. This aint the end of the world.
BCO
An old friend of mine used to say, "A thousand dollars is not a lot of money unless you need it."
Anyway, since this thread appears to want to warn others to be careful when dealing with a particular person, maybe we should be told who it is that we should avoid dealing with. It wasn't me, was it?
You know I made a comment earlier that it costs about a thousand bucks to fill your fuel tank (little less now) and said to just forget it. Well I don't know the whole story and the money situation of the parties so if this whole thread just disappeared it wouldn't hurt my feelings. To the OP I sincerely hope your wife is well now
